GENERALI OSIGURANJE SRBIJA a.d.o. (hereinafter: The Company) collects personal data from the insured/beneficiary and/or the claimant when handling requests for payment of a claim/indemnity/sum insured through the claim filing application.
Purpose of processing, legal basis, and retention period
Data access and portability
The Company shares personal data with third parties with which it has entered into a service contract, with the reinsurer or co-insurer in order to meet contractual obligations, with members of the Generali Group, third parties cooperating with the Company in the claim settlement process, who must have access to such data under the law (the National Bank of Serbia and other authorities, external auditors, courts, etc.).
In order to meet the requirement under point 1, the Company shares personal data (personal details and addresses required for non-life insurance claim settlements regarding claimants, vehicle owners, passengers and other parties) with Livegenic Inc ("Livegenic"). The transfer of data abroad is carried out by providing adequate protection, in accordance with Article 65 of the Law on Personal Data Protection.
In order to meet the requirement under point 2, the Company shares the applicant’s details (first name, last name, email address, and telephone number) with Medallia Ltd. The transfer of data abroad is carried out by providing an adequate level of personal data protection, in accordance with Article 64 of the Law on Personal Data Protection.
Data processing rights
The insured/beneficiary and/or the claimant has all the legal rights regarding personal data processing: the right to access, rectify, and erase personal data, the right to restrict data processing, to object, and to transfer the data. If the applicant has given consent to personal data processing, they can withdraw the consent at any time, under the Law on Personal Data Protection. Withdrawal of consent shall not affect the permission to process data based on consent prior to withdrawal.
If they believe that the personal data processing was carried out against the Law on Personal Data Protection, the insured/beneficiary and/or the claimant has the right to file a complaint to the Commissioner for Information of Public Importance and Personal Data Protection.
